1. By subscribing to Victorian Database Online or by using Victorian Fiction:
An Online Research Guide, the customer has deemed to have agreed to comply
with all of the terms and conditions of this License.
2. The customer is hereby granted a non-exclusive license for the period
covered by subscription to conduct searches of the database, to store
or print single copies of portions of the database for the customer's
personal use or the customer's organization's internal use.
3. The customer's rights are limited to itself alone and do not extend
to subsidiary or parent corporations, or to any other related or affiliated
faculties, departments or organizations.
4. Under this agreement, the licensee may not copy the web site or the
database contents for any purpose other than those specified in Clause
1 above.
5. Any commercial use, including but not limited to renting, leasing,
sub-licensing, transferring or creating derivative works, is strictly
prohibited.
6. The text, program and interface of this database are the sole property
of the copyright holders. Permission to use any of the material other
than for those specified in Clause 1 of the license must be obtained in
writing from the copyright holders.
7. The customer is responsible for all use of its Account specified by
IP address range under any user ID (username) or password by any person
within the IP address range and for ensuring that all use of its Account
complies fully with the provisions of this License.
8. This database, its program, its contents, and related material are
governed by the laws of the Province of British Columbia, of Canada and
by international copyright treaty provisions.
9. The licensee hereby releases LITIR Database, Inc. and its respective
directors, officers, employees and agents from any and all claims or causes
of action which the licensee may have at any time against any of them
arising in any manner in connection with the Product or any part thereof.
The licensee hereby grants that there are no representations or warranties
concerning the Product or the Database contained therein or the performance,
quality or ownership thereof, whether express, implied or collateral,
whether arising by operation of law or otherwise for which LITIR Database,
Inc. or its respective directors, officers, employees and agents are responsible
in any manner. The licensee further agrees that neither LITIR Database,
Inc., nor any of its respective directors, officers, employees, or agents
has any liability to the licensee for any direct, indirect, incidental,
special or consequential damages however caused, whether based on negligence,
collateral contract or otherwise.
